Amid stricter immigration regulations put into place by the Donald Trump administration, the US Embassy in India has provided clarification regarding the length of time that travelers are permitted to remain in the United States. Indian nationals can only stay in the United States for as long as they are allowed to remain there by U.S. Customs and Border Protection Officers, and not by the expiration date on their visa.

What determines the length of stay for travelers in the U.S.?

Sharing a post on X(previously Twitter), U.S. Embassy India stated, “Reminder! The length of time an international visitor is allowed to stay in United States is determined by the Customs and Border Protection officer upon arrival, NOT the visa expiration date. To see how long you can stay, check your I-94 “Admit Until Date” at https://i94.cbp.dhs.gov.”

When should travelers check their I-94 form?

As per the official website of the Department of Homeland Security, International travelers visiting the United States can apply for a provisional I-94 or retrieve their I-94/I-95 admission number/record (which is proof of legal visitor status) as well as retrieve a limited travel history of their U.S. arrivals and departures.

Every non-immigrant traveler must have an I-94. The I-94 determines how long the traveler may remain in the United States. The duration of stay will be different from the expiration date on their visa. According to the Department of Homeland Security, all travelers who arrive via air or sea will be provided with an electronic version of the I-94, so there is no need for a separate application.

Visiting the U.S. & Arriving Via a Land Border or Selected Ferry?

According to the official website, a Form I-94 is needed by all visitors except: U.S. Citizens, returning resident aliens, aliens with immigrant visas, and most Canadian citizens visiting or in transit. Travelers will be issued an I-94 during the admission process at the port of entry. If you are traveling via a land border or by ferry from selected ports, you may apply for a provisional I-94 in advance here, saving time while at the port of entry later. If you are a crew member in need of an I-95, one will be issued at the time of arrival.

Another 15 countries – Angola, Antigua and Barbuda, Benin, Cote d’Ivoire, Dominica, Gabon, The Gambia, Malawi, Mauritania, Nigeria, Senegal, Tanzania, Tonga, Zambia and Zimbabwe – will face partial restrictions.The proclamation also “narrows broad family-based immigrant visa carve-outs that carry demonstrated fraud risks, while preserving case-by-case waivers,” the White House said.
