
Bhopal: The Madhya Pradesh high court has vacated the interim stay on the arrest warrant issued against Trinamool Congress (TMC) MP Abhishek Banerjee, nephew of outgoing chief minister of West Bengal Mamata Banerjee, in a defamation case.
A single bench of Justice Pramod Kumar Agrawal, in a ruling on Wednesday, lifted the interim stay on the TMC leader’s arrest warrant issued by the MP-MLA Special Judge, Bhopal, on November 12, 2025 for non-representation of his case during the hearing, despite warning earlier for similar reason.
“No one has appeared on behalf of the petitioner in the first round also. It seems that the petitioner has lost interest in prosecuting this petition…. Accordingly, the stay granted in favour of the petitioner vide order dated 12.11.2025 is also vacated. Registry is directed to send a copy of this order to the Trial Court concerned immediately”, the court directed.
The case relates to an election speech by the TMC general secretary Banerjee at a rally, held in Kolkata in November 2020, in which he purportedly called BJP leader Akash Vijayvargiya, son of Madhya Pradesh urban development minister Kailash Vijayvargiya, a ‘goon’.
Vijayvargiya Senior was elections in-charge of BJP for West Bengal then.
Akash had filed a defamation suit in the MP-MLA Special Judge court, Bhopal, against the TMC leader for calling him ‘goon’, leading the court to issue an arrest warrant against the latter.
Abhishek had then moved the high court challenging the arrest warrant issued by the trial court and secured an interim stay on the execution of the arrest warrant.
The matter before the high court was later adjourned from time to time.
The high court finally listed the matter on June 16 while warning that the interim stay on the arrest warrant will be vacated on June 17 if the case is not argued on behalf of Banerjee on the listed date.
