The Los Angeles County District Attorney Office has confirmed to the Mirror that they are not considering the death penalty for Rob Reiner’s son Nick, who is accused of murdering his parents

Nick Reiner, who is accused of murdering his parents, Rob and Michele Reiner, will not face the death penalty if found guilty, the LA County District Attorney’s Office has confirmed.
Reiner, 33, is set to appear at a Los Angeles courtroom for a pre-trial hearing this week, after being indicted for the murder of his parents, film producer Rob and photographer Michele. During the indictment, it was alleged that Reiner used a knife to kill his 78-year-old father and 70-year-old mother in their Brentwood home. Reiner has pleaded not guilty to the charges.
It was been reported that the LA County District Attorney Nathan Hochman will not push for the death penalty when the trial begins. This was confirmed this to the Mirror, when a spokesperson said: “Our office is not seeking the death penalty in the Reiner case.”
In a press conference afterwards, Hochman added that this came after a “careful and thorough review” of the case. “That means that the maximum sentence that Mr. Reiner will be looking at is life without the possibility of parole,” Hochman continued.
Reiner has been charged with two counts of first-degree murder with special circumstances, for which the only sentences available in California are life in prison without parole or death.
‘Special circumstances’ refers to 22 listed scenarios where either the victim or method of murder is considered ‘special’ and in need of a more severe punishment. In this case, it has been alleged that Reiner was “lying in wait” for his parents.
Hochman also said in the conference that the decision not to seek the death penalty was based on the opinions of the remaining Reiner siblings, Jake and Romy Reiner: “We did speak to Nick Reiner’s siblings. They made their views very clear, and we took their views into consideration in ultimately deciding not to seek the death penalty.”
Before he died, film producer Rob Reiner was also strongly opposed to the death penalty. He spent decades opposing the death penalty. Shortly after Charlie Kirk’s murder, he praised the political operative’s wife, Erika, for forgiving her husband’s shooter, stating that no one should face death “no matter their politics”.
The last time a person was executed in California was in 2006, though people have been put on death row in the state in the following decades. California’s current Governor Gavin Newsom has made his opposition to the death penalty clear too. In 2019, Newsom halted 737 executions and said the death penalty was “unevenly and unfairly applied to people of color, people with mental disabilities, and people who cannot afford costly legal representation”.
Rob and Michele Reiner were killed on 14 December 2025, and their son was arrested soon after. Before his death, Reiner was well known as a director and producer of films such as The Princess Bride and When Harry Met Sally. He also acted, appearing in Sleepless in Seattle, The First Wives Club, The Bear and more.
