The Andhra Pradesh High Court on Tuesday reserved its verdict on petitions filed by Vijayalakshmi seeking directions to the police to produce her son Gade Sai Krishna before the court and a CBI inquiry into his custodial death and the disappearance of his body.
A division bench comprising Justice Ravi Nath Tilhari and Justice Alapati Giridhar heard the petitions and directed the police to produce the chargesheet filed before the lower court in a sealed cover.
Petitioner’s counsel N. Ashwani Kumar argued that the police had taken Sai Krishna into custody, harassed him and killed him. He submitted that an interlocutory application had been filed seeking a CBI probe.
He said the state government had constituted a special investigation team (SIT) to probe the case and argued that, as the SIT comprised state police personnel, there may not be a fair probe. He sought that the case be handed over to the CBI.
Special Government Pleader Singamaneni Pranithi, representing the police, submitted that the chargesheet had already been submitted before the court concerned and all the accused had been arrested. She further submitted that Gade Sai Krishna died due to custodial torture and argued that a CBI probe was ordered only in rare cases and that the present case did not qualify for one.
After hearing both sides, the court reserved its verdict.
