Halle Berry is currently making headlines for all the wrong reasons. Her personal life has come under intense scrutiny following child abuse allegations made by her ex-husband, Olivier Martinez. He accused her of attacking their 12-year-old son, Maceo, and requested sole custody and a temporary restraining order against her. As the court granted the temporary restraining order, Halle fired back at the allegations by citing Oliver’s violent past.

Halle Berry is currently facing allegations of being violent towards her minor son, whom she shares with her ex-husband, Olivier Martinez. According to court documents filed in early October 2026, Oliver claimed that Halle choked their son during a heated argument that took place on September 26, 2026. The court partially granted and partially denied the request, ordering Halle to stay at least 100 yards away from him.
Halle will, however, be allowed unsupervised meetups with their preteen son. She can see Maceo only during court-ordered visitation, which is two days a week and every other weekend, until an October 16, 2026 hearing. Amid that, her fiery response to the accusations emerged, in which she vehemently denied the damaging claims. Halle responded through her attorney Marina Beck, who told TMZ that the court filing was baseless.
Halle’s lawyers defended her by citing Oliver’s past acts of violence, claiming that there was ample evidence against him. Attorney Marina stated that he “violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo.” Marina added that Oliver has already been legally sanctioned for his behavior and stated:
“To say this filing is entirely meritless and deliberately misleading would be an understatement. There is voluminous evidence…[of his] misconduct for which Mr. Martinez has already been legally sanctioned.”
Halle Berry’s counsel didn’t specify which violent incident(s) she is talking about, but she reportedly at least referred to Olivier’s infamous 2012 Thanksgiving attack on Halle’s then-boyfriend, Gabriel Aubry. For the unversed, Gabriel alleged that Olivier hit him, slammed his head against the concrete driveway, and threatened to kill him during a custody dispute involving Halle and Gabriel’s daughter, Nahla.
Marina claimed that Halle expected a “meritless” lawsuit from an “erratic, possessive and violent” person like Oliver. The lawyer added that the actress had gotten used to Oliver “outrageous conduct,” but she would not get scared and step back from fighting for her son. Halle’s attorney assured that they would take all necessary steps while keeping the best interests of 12-year-old Maceo in mind. In Marina Beck’s words:
“In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive, and violent behavior. Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”

Oliver Martinez claimed that Halle Berry has caused their son, Maceo, physical and emotional harm, which is why she needed to stay away from the preteen. Oliver alleged that she physically attacked Maceo by jumping on him and putting her hands around his neck and choking him. Taking note of the alleged violence, the court ordered Halle to stay 100 yards away from Maceo; however, it allowed her unsupervised visits with her son.
Olivier also appealed for sole custody of 12-year-old Maceo, which remains subject to court ruling. Halle and Olivier were married from 2013 to 2016 and finalized their divorce in 2023 after almost eight years of negotiation. They currently share custody of Maceo.
