Christa Pike was hospitalized on the night of September 30, 2026, following her botched execution at Riverbend Maximum Security Institution in Nashville. According to the latest reports, 50-year-old Pike is still in critical condition and remains on a ventilator. In fact, her attorney, Stephen Ferrell, said he believes Pike may not fully recover.
For the unversed, Christa survived two doses of pentobarbital. But the attempted execution took a serious toll on her. Now, in an interview, a legal expert explained why Tennessee had to save Christa after the botched execution.
Legal expert Robin Maher reacts to Christa Pike’s botched execution
Executive director of the Death Penalty Information Center Robin Maher told Nexstar’s WKRN that what happened to Pike was unprecedented. Robin shared that the first emotion she felt was shock. She shared that this was the first time someone survived two doses of lethal injection. According to Tennessee’s death penalty protocol, a second dose of pentobarbital can be administered only if the first dose doesn’t result in death. She said:
“We’ve never had someone survive an execution effort after receiving not one, but two doses of execution drugs.”

However, the protocol doesn’t tell the state what to do if a second dose doesn’t work. Maher explained that when the second drug failed to act, the prison staff did not know what to do next. They became confused as the execution did not go as planned. As Pike was still alive but critically ill, staff arranged for the emergency services. Maher said:
“When that second drug did not work, it seemed like the staff was simply flummoxed. They didn’t know what to do. That resulted in a flurry of activity, ultimately bringing emergency vehicles to take her to the hospital.”
Robin Maher explains why Tennessee had to save Christa Pike after the failed execution
After the two lethal-injection drugs failed to kill Christa Pike, Tennessee officials had to change their plan. They were originally trying to carry out her death sentence, but when Pike survived and became seriously ill, they had to call emergency medical help and take her to the hospital. Robin Maher said Tennessee did not really have another option.
In the same interview, Maher explained that although the states have the legal authority to carry out a death sentence, they still have a responsibility to protect prisoners from cruel and unusual punishment under the Eighth Amendment of the U.S. Constitution. According to Maher, the death row inmate should not be tortured. However, Maher believes that Christa was tortured. She said:
“The United States Constitution has protections for all, even people who have committed terrible crimes. They should not be gratuitously inflicted with pain and suffering, and that’s exactly what appears to have happened.”

It is worth mentioning that during her failed execution, Christa Pike reportedly said that her arm was ‘burning and hurting’. WPLN reporter Catherine Sweeney also mentioned that Christa said there was a spot that was burning and hurting. Later, her attorneys said that Pike’s both arms were badly injured. They described the injuries as ‘swollen, burned and blistered’.
Before her attempted execution, Pike’s attorneys challenged Tennessee’s lethal injection process and asked that, if the state proceeded with execution, she be hanged. They cited Pike’s blood disorder, difficulties with accessing her veins, and her history of trauma, arguing that lethal injection could cause unnecessary suffering. Her legal team revealed the IV team used at least seven needles in an effort to establish access, and one needle was bent at a 90-degree angle when it was removed from her body.
After Christa’s botched execution, Tennessee Governor Bill Lee stopped all executions in the state for the rest of 2026 and ordered an independent investigation to find out exactly what went wrong during Pike’s execution attempt.
