Hyderabad:After a 17-year-long dispute over the District Selection Committee (DSC) recruitment, the Telangana High Court has dismissed a batch of petitions challenging the reservation of 30 per cent of secondary grade teacher (SGT) posts for candidates possessing a Diploma in Education (DEd) qualification.

A division bench comprising Acting Chief Justice P. Sam Koshy and Justice Suddala Chalapathi Rao ruled that the government’s decision to earmark 30 per cent of SGT vacancies for DEd-qualified candidates was not an impermissible change in the rules of recruitment midway through the selection process.

The case of the petitioners was that they possessed BEd qualification. The government issued a notification dated 06.12.2008 notifying various categories of posts, namely school assistants, secondary grade teachers, language pandits and physical education teachers, aggregating 52,655 posts across the undivided state. While the process was underway, the authorities issued an amendment to the notification through GO 28, dated January 29, 2009, stating that 30 per cent of SGT posts would be reserved exclusively for candidates possessing DEd. qualification, with both BEd. and DEd. candidates being eligible for the remaining 70 per cent of posts on the basis of common merit in the DSC, subject to the other applicable rules of recruitment.

The petitions were filed in 2009 by BEd-qualified candidates who challenged the amendment introduced through GO 28, contending that the government had altered the recruitment rules after issuing the original notification on December 6, 2008.

Rejecting these arguments, the High Court distinguished the present case from those in which selection criteria were altered after candidates had undergone the examination or evaluation process. It noted that the amendment was introduced before issuing of hall tickets and the written examination, and candidates were given additional time to apply or reconsider their participation in light of the revised rules.
