Alex Murdaugh recently made headlines after the South Carolina Supreme Court overturned his 2023 convictions. The ruling left everyone in shock. Does Alex Murdaugh have a better chance now that his conviction has been overturned?

Alex Murdaugh’s case got interesting once again. The double murder convict is now in line for a retrial after the South Carolina Supreme Court overturned his 2023 convictions, according to attorneys who spoke to the New York Post. The reports suggest that Alex now has a better chance of acquittal in the murder trial. For the unversed, the disgraced South Carolina lawyer had been serving two consecutive life sentences without parole after being convicted of killing his wife, Maggie, and son, Paul, in 2021.

However, now, in a dramatic ruling on Wednesday, May 13, 2026 (ET), the state Supreme Court unanimously tossed the verdict. According to reports, the Supreme Court cited misconduct by former Colleton County Clerk, Becky Hill, for discarding the initial verdict. The ruling ordered a retrial and reopened one of the country’s most closely watched murder cases.

What are the attorneys saying about the overturn?

Columbia-based defence lawyer, Tyler Bailey, told the New York Post that Alex Murdaugh’s legal team now has the benefit of hindsight after the heavily publicised first trial. He shared that the team can now attack the case from a different angle, now that they know what worked in their favour and what worked against them. He claimed that the defence now better understands public perception surrounding the case. He also argued that years of Netflix documentaries, commentary and media attention may actually help Alex’s case and give the defence what they need to revised strategy for the retrial. He was quoted as saying:

“[Murdaugh’s defence lawyers] can try to attack the case from a different angle.”

Defence attorney, Dayne Phillips, also gave a similar analysis of the situation. He revealed that changes in expert testimony and courtroom presentation could “significantly improve” Alex Murdaugh’s chances of acquittal compared to the original trial.

Why could jury selection become difficult for the retrial?

Even with the overturned conviction, attorneys acknowledged that prosecutors still possess substantial evidence against Alex Murdaugh, which puts him as the prime suspect. Dayne Phillips revealed that one of the biggest challenges could be finding impartial jurors after years of media coverage. For the unversed, the original six-week murder trial of Alex Murdaugh became one of the most publicised criminal proceedings in South Carolina history and inspired multiple documentaries, podcasts and television specials, which means that people’s judgments might be impacted by what they have seen, making it hard for them to remain impartial during the proceedings. He was quoted as saying:

“It’s going to be impossible, just about, or improbable to find 12 people who don’t know anything about the case.”

Supreme Court cites clerk misconduct

The South Carolina Supreme Court ruled that Becky Hill influenced jurors during the original proceedings, writing that she “placed her fingers on the scales of justice.” Later, Becky pleaded guilty to obstruction of justice, perjury, and misconduct charges tied to sharing sealed crime-scene photographs and promoting her book about the trial. The court also ruled that prosecutors introduced too much testimony about Alex Murdaugh’s financial crimes during the murder case, creating what the defence called “unfair prejudice.”

However, despite the overturned murder convictions, Alex is not expected to leave prison anytime soon. He is separately serving federal and state prison sentences for financial crimes after admitting to stealing millions from clients.
