NEW DELHI: The Centre has extended the Punjab Prisons and Correctional Services Act, 2026, to Chandigarh, introducing provisions for transferring prisoners between the Union Territory and other states and Union Territories.
The notification, issued by the Union home ministry on Friday under Section 87 of the Punjab Reorganisation Act, 1966, extends the legislation to Chandigarh with certain modifications.
Under the amended provisions, prisoners serving sentences in Chandigarh, including those sentenced to life imprisonment, may be transferred to prisons in other states or Union Territories with the consent of the government concerned and an order issued by the Chandigarh administration.
The provisions also permit the transfer of prisoners from other states or Union Territories to Chandigarh with the consent of the governments concerned.
Undertrial prisoners may be transferred from Chandigarh to another state or Union Territory in the interest of security, maintenance of law and order or public interest.
Such transfers require the consent of the governments concerned and approval of the court before which the trial is pending.
The amendments also regulate the operation of aerial objects within designated no-fly zones around prisons. Such operations will require permission from the competent civil aviation authority and prior approval of the prison department.
The notification further provides for regular training of prison staff to sensitise them to the rights and needs of prisoners with disabilities.
It also replaces references to the Punjab Transparency in Public Procurement Act, 2019, with the General Financial Rules, 2017, for the application of the legislation in Chandigarh.
