She also agreed to pay him “4.3% of any income she receives above USD 2,000,000” in additional support.
The former couple agreed to the joint custody of their son, Maceo, which means they share decision-making on things such as their son’s school enrollment, doctor appointments, and counseling. Under the settlement, Berry pays for Maceo’s private school tuition, uniforms, school supplies, and any extracurricular activities.

In August 2024, the Die Another Day actress requested sole custody of Maceo due to Martinez’s alleged “turbulent and detrimental behavior.” In the filing, Berry claimed Maceo was dealing with “serious behavior and learning problems,” and that Martinez had refused to obtain a tutor for Maceo because it could interfere with his soccer schedule.
In October 2026, the bitter feud between the former partners came to a climax when Martinez accused Berry of physically abusing their son and filing for sole custody of Maceo. In the September 26, 2026, filing, Martinez claimed that the actress put her hands around Maceo’s neck and choked him; as a result, the young lad panicked and called him at the scene.
In court documents reviewed by Newsweek, Martinez also alleged that Berry, who “has been trained as an MMA fighter,” has, on multiple occasions, put Maceo in a chokehold and held it there until he ‘taps out’.” The accusation can be read as:
“There have been multiple times when [Berry] has unprovokedly grabbed our son’s neck from the back when he was not looking and forced him to tap out.”

After Martinez filed, Judge Shelley Kaufman issued a temporary order restricting Berry to unsupervised daytime visits with her son. Her attorney called Martinez’s filing “entirely meritless and deliberately misleading.”
