Halle Berry's Son Wants To Testify About Her Abuse, Ex Olivier Objects To Her Daughter's Testimony

Halle Berry and Olivier Martinez’s ongoing custody dispute over their 13-year-old son, Maceo, has taken another turn, with Martinez telling the court that their son wants to share his account of his mother’s alleged physical abuse that Berry has firmly denied.

In recent court documents, Martinez argued that his minor son should be allowed to speak directly to a judge about what he says happened at Berry’s home on September 26, 2026. The actor has also challenged the involvement of Berry’s elder daughter, Nahla, 18, who submitted a statement defending her mother and denying that she had witnessed such abusive behavior.

Olivier Martinez says son Maceo wants to tell his side of the story to the court

According to court documents obtained by PEOPLE, Martinez said Maceo wants to address the court about the alleged September incident and his custody preferences. Martinez wrote in his declaration, “He should have the opportunity to have his voice heard regarding what he experienced that night,” adding that he was concerned his son might feel discouraged from reporting problems in the future if he were prevented from speaking to the judge.

The Unfaithful actor also claimed that Maceo had previously raised concerns about his mother’s alleged behavior with therapists but felt those concerns were dismissed. According to Martinez’s filing, their son wanted to be taken seriously and believed that providing photographic evidence of the alleged incident could help support his account.

TMZ previously reported that Martinez claimed Maceo took a photograph of Berry following the alleged altercation. Things escalated after Martinez sought a temporary restraining order on behalf of himself and Maceo on October 1, 2026, and requested changes to the former couple’s shared custody arrangement.

Berry has strongly denied the allegations. In a statement filed with the court, she said, “I have never physically, emotionally, or otherwise abused Maceo.” Rather, she described herself as a victim of domestic violence and stated that she would never hurt her child. Her daughter has also said she never saw her mother be abusive to Maceo.

Why Olivier Martinez objects to Halle Berry’s daughter’s statement in custody dispute

Alongside his request for Maceo to be presented to the court, Martinez has objected to the involvement of Berry’s elder daughter, Nahla, in the custody dispute. Nahla, 18, is Berry’s daughter with her former partner Gabriel Aubry. In court documents obtained by Us Weekly, Martinez argued that Nahla did not have a significant bearing on the case and questioned whether her perspective could be impartial. Martinez stated:

“Ms Aubry does not have any significant bearing on this case…Ms Aubry is unquestionably biased. I do not believe it is appropriate for (Berry) to try to insert her daughter into litigation that does not involve her.”

Nahla previously submitted a sworn statement supporting her mother. She said she had never witnessed Berry physically abuse Maceo or seen her mother act violently toward anyone. In a court declaration obtained by PEOPLE, Nahla reportedly wrote, “I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way.” She also described Berry as a loving and devoted parent who was always involved in her children’s lives.

The contrasting statements from Martinez and Nahla further complicate the increasingly contentious nature of the custody dispute. While Martinez argues that Maceo should be able to explain his experience directly to the court, Berry and her legal team have denied the allegations at the center of the case.

The former couple, who currently share 50-50 custody of Maceo, are continuing to contest issues involving their son’s welfare and the circumstances surrounding the alleged September altercation.

The dispute has also involved disagreements over Maceo’s medical care. Martinez has disputed Berry’s characterization of him as uncooperative, claiming that their son’s pediatrician and psychiatrist had decided in September that medication was not appropriate at that time. None of the allegations have been established in court so far.
