HC Orders Probe Into Custodial Torture Charge

Hyderabad:Justice N. Tukaramji of the Telangana High Court directed registration of a criminal case and a probe by a Special Investigation Team or CID into allegations of illegal detention, custodial torture and coercion made by a Rajasthan-based agriculturist against police officials and private individuals. The writ petition was filed by Jogaram Lohar, challenging the alleged illegal actions of officials attached to Banjara Hills police station and private respondents in unlawfully detaining him in Rajasthan and Hyderabad, forcibly obtaining a general power of attorney and seizing his original land documents. According to the petitioner, he was unlawfully apprehended in February 2018, taken to Rajasthan and Hyderabad, confined at different locations for several days and coerced into executing documents relating to his agricultural land. He alleged that the criminal case relating to offences of cheating, criminal breach of trust and theft of silver ornaments was misused to threaten and harass him. Opposing the plea, the state submitted that the police acted strictly in accordance with law, that the investigation culminated in filing of a chargesheet, and that the dispute was later settled before the Lok Adalat. On examining the record, the judge found prima facie inconsistencies in the stand of the respondents, observing that while the police claimed lawful arrest and remand, the name of the petitioner did not appear in the FIR, remand report or chargesheet. The court held that the discrepancies raised serious concerns over the legality of the detention of the petitioner and required an independent and impartial probe. The judge directed the Director General of Police to ensure registration of a crime based on the allegations of the petitioner and entrust the investigation to an SIT or CID within four weeks. The court directed that the probe be completed preferably within six months with periodic status reports to be placed before the jurisdictional magistrate.

The Telangana High Court granted anticipatory bail to a woman accused in an alleged Dubai job scam, holding that the complaint failed to attribute any specific overt acts to her despite allegations of cheating and illegal overseas recruitment. The vacation court was hearing a criminal petition filed by Pabba Swapna seeking anticipatory bail in a crime registered by the Mallapur police, Jagtial district, for offences under the Bharatiya Nyaya Sanhita and the Emigration Act. According to the prosecution, the accused allegedly induced several persons to pay substantial amounts on the promise of securing employment in Dubai through licensed agencies. The complainant alleged that despite payment of money, the promised jobs and salaries were never provided, and the victims were subsequently threatened and forced to return to India. Counsel for the petitioner contended that the allegations in the complaint were directed primarily against Accused No.1 and that no specific role had been attributed to the petitioner, who was arrayed as Accused No.3. The state opposed the plea, arguing that the allegations were serious in nature. After examining the material on record, the court observed that no specific overt acts are been alleged against the petitioner in the complaint and held that the case warranted grant of pre-arrest bail. Accordingly, the court allowed the petition and granted anticipatory bail subject to conditions.
