Alex Murdaugh’s shocking double murder case is back in the headlines after the South Carolina Supreme Court recently overturned his convictions for killing his wife, Maggie Murdaugh, and son, Paul Murdaugh. While he always maintained that he didn’t kill them, the once-powerful attorney was sentenced to two consecutive life terms in what is being called one of America’s most infamous true crime trials.
With the conviction overturned, many are wondering where Murdaugh is kept while he awaits the new trial. Is he still in prison? The answer is yes. Here’s why.
Why was Alex Murdaugh granted a new trial, three years after his original conviction?

In a new hearing held on May 13, 2026, the South Carolina Supreme Court ruled that Alex Murdaugh deserved a retrial due to alleged jury tampering and misconduct involving the former Colleton County Clerk of Court, Rebecca “Becky” Hill. In 2023, after a highly publicised six-week trial, Murdaugh was accused of killing his family to cover up his financial crimes.

However, even after the sentencing, Murdaugh insisted that he was innocent, and even behind bars, his case continued to make headlines. In 2024, the South Carolina Supreme Court agreed to a new trial after the court’s clerk, Becky Hill, was accused of jury tampering, but the latter denied the allegations. Finally, in the new hearing, the court announced the remand for a new trial. The justices wrote:
“Although we are aware of the time, money, and effort expended for this lengthy trial, we have no choice but to reverse the denial of Murdaugh’s motion for a new trial due to Hill’s improper external influences on the jury and remand for a new trial.”
Inside Alex Murdaugh’s original conviction

Alex Murdaugh was convicted in March 2023 for the murders of Margaret “Maggie” and Paul Murdaugh, with prosecutors alleging that he fatally shot both of them near the dog kennels of the family’s sprawling hunting property in South Carolina in June 2021. According to investigators, the motive centered around Murdaugh’s mounting financial scandals. An NPR report stated that the former lawyer stole more than USD 12 million from clients and his family’s law firm.

His 22 counts of financial fraud mainly involved stealing from settlements intended for victims. Murdaugh reportedly stole a USD 4.3 million insurance payout owed to the family of the Murdaughs’ longtime housekeeper, Gloria Satterfield, who mysteriously died after an alleged “trip and fall” at their home in 2018. His other frauds included bank fraud, wire fraud, and money laundering.

During the trial, prosecutors also pointed toward his opioid addiction, financial pressure, and crumbling public image. All his financial misdeeds, together with his son Paul’s upcoming trial for a 2019 boating accident that killed a teen, allegedly motivated Alex to commit the murders. Although Alex initially denied being near the kennels that night, he later admitted during testimony that he had lied about his whereabouts.
Where is Alex Murdaugh now?
Alex Murdaugh, now 57, remains incarcerated despite the court’s decision for a retrial for the murders of Maggie and Paul Murdaugh. Even if he is eventually acquitted in the retrial, he still faces decades behind bars because of financial crime convictions. Apart from the murder case, Murdaugh pleaded guilty to multiple counts of fraud, money laundering, wire fraud, and stealing settlement money from clients. His 22 counts of financial fraud put him in a 40-year prison sentence.

Given the high-profile nature of the ongoing case, the exact location of Alex Murdaugh has been kept confidential. However, reports say he is serving his sentence in a maximum-security prison in South Carolina. However, based on information from the South Carolina Department of Corrections, Alex is housed in a protective custody unit, isolated from the general population for his own safety.
The Murdaugh murder case is now headed towards a fresh trial, and Alex and his legal team continue to maintain his innocence. What are your thoughts on the case?
