Moinabad Farmhouse Party Case: HC Grants Bail to Accused

Hyderabad: The Telangana High Court granted bail to a man accused in the Moinabad farmhouse party case involving alleged consumption of narcotic substances, illegal possession of firearms and firing at police personnel during a raid conducted in March. The court was hearing a criminal petition filed by Namit Sharma, arrayed as an accused in a crime registered at Moinabad Police Station under provisions of the NDPS Act, Arms Act, Telangana Excise Act and the Bharatiya Nyaya Sanhita.

According to the prosecution, the police conducted a raid on a farmhouse on March 14 after receiving credible information that several persons were consuming narcotic and psychotropic substances along with liquor during a party. During the raid, a gunshot was allegedly fired from inside the farmhouse towards the police and threats were allegedly issued to deter officials from discharging their duties. Prosecution claimed that the petitioner was apprehended with a revolver, while another accused was allegedly found holding empty cartridges. It was further alleged that cocaine was procured for the party and that urine tests of several persons present on the premises returned positive for drug consumption. Counsel for the petitioner Shasidhar Reddy contended that no contraband was recovered from the petitioner and that the quantity allegedly seized in the case was only 0.26 grams of cocaine, falling below small quantity threshold under the NDPS Act. It was further argued that several other accused had been released on notices under the BNSS, while the petitioner alone remained in custody despite standing on the same footing. The state opposed the plea, contending that the petitioner opened fire at the police with a revolver and that serious offences under the NDPS Act and Arms Act were attracted. The Court observed that although firing was alleged, the shot was stated to have been fired in the air and the petitioner had already undergone substantial custodial interrogation. The Court also noted that no previous NDPS case was registered against the petitioner and that the alleged contraband was a small quantity. The judge accordingly granted regular bail subject to conditions.

HC rejects doctor’s plea for medical registration

Justice Renuka Yara of the Telangana High Court refused to entertain a plea seeking permanent medical registration without furnishing Secondary School Certificate (SSC) details, holding that no case for issuance of a writ was made out. The judge was dealing with a writ petition filed by Dr Ali Anwaar Qureshi, who sought a direction to the Telangana State Medical Council to consider his application for permanent registration and to clarify his eligibility. He also sought a modified application process on the ground that he completed his entire education and professional training in the United States, where there is no system of Secondary School Certificate marks. The respondents contended that the petitioner did not submit any proper representation before the competent authority and merely sought written instructions. It was further submitted that any any qualification equivalent to secondary education would suffice. Finding no merit in the petition, the judge dismissed the writ petition.
