Controversial influencers Andrew Tate and Tristan Tate are once again under fire after their recent arrest. The brothers were arrested on Saturday by the U.S. Marshals Service in Miami after British authorities announced a major expansion of the criminal case against them. They are now facing 38 new charges that include rape, sexual assault, sex trafficking, and child pornography-related offences.

According to reports by the U.S. Marshals Service, the Tate brothers were arrested in Miami pursuant to extradition proceedings after the UK’s Crown Prosecution Service (CPS) announced additional criminal charges following a new file of evidence submitted by Bedfordshire Police.
The brothers are being charged with new offences in addition to their past allegations, said to have occurred between July 2010 and August 2017. The offences reportedly involve seven alleged victims, up from three in the earlier case. While U.S. authorities have not publicly released the sealed warrant, British prosecutors confirmed the arrests are linked to their request to extradite the brothers to face trial in the UK.
Before their recent arrest, the controversial influencer duo was already facing 21 charges filed against them. Andrew Tate now faces 32 additional offences, including 7 further counts of rape, 3 counts of arranging or facilitating trafficking for sexual exploitation, 3 counts of assault occasioning actual bodily harm, and 19 offences relating to indecent images of a child and extreme pornography.

These charges are in addition to the 10 charges the 39-year-old was already facing in the UK, including rape, human trafficking and controlling prostitution for gain.
On the other hand, his brother, Tristan, is facing six additional charges for multiple offences. His charges include one count of sexual assault, two counts of rape, and three counts of arranging or facilitating trafficking for sexual exploitation. These are added to the 11 charges he was already facing in Britain.
Together, the latest indictment brings 38 new charges against the brothers, with their overall charges now totalling 59. The brothers, however, have continued to deny the allegations.
Will the Tate brothers be extradited to Britain? Their attorney speaks out
Given that the arrests happened in Miami, it does not automatically mean that the Tate brothers will be immediately extradited to Britain. As per U.S. law, the matter first goes to a federal court where it is determined whether the UK’s extradition request satisfies the requirements of the U.S.-UK Extradition Treaty. If the court approves the request, the final decision generally rests with the U.S. Secretary of State.
The brothers are also linked to a separate legal case in Romania, where they were previously investigated over allegations of human trafficking and rape. They have denied wrongdoing in those proceedings as well.

Hours after the arrest, the influencer duo’s U.S. attorney, Joseph McBride, shared a public statement criticizing the latest prosecution, calling the new charges “filth and slander”.
McBride argues that the new charges are nothing but planned-out tactics to derail the brothers’ ongoing legal actions in the United States. A part of his statement reads:
“The world knows Andrew and Tristan Tate are innocent. Their enemies know it best of all. That is exactly why they have been attacked… This is a political hit ordered by a dying empire that fears two free men with a microphone more than it fears actual criminals walking its streets.”

As of now, Andrew and Tristan Tate remain banned from Instagram, Facebook, TikTok, and YouTube, primarily for violating hate speech and “dangerous individuals” policies. They remain active on X.
The CPS emphasized that the criminal proceedings remain active and both Andrew and Tristan Tate are entitled to a fair trial.
