During the protests that were held at Kranti Maidan in India on October 10, Imran Khan was briefly detained for his participation. As per the notice given by the police, Imran Khan has been instructed to leave India by October 28 for his presence at the political protest.

Now the Bombay High Court has addressed that the final hearing would be conducted on October 27, following a plea registered by Imran Khan’s counsel, Venkatesh Dhond and his solicitor, Tushar Mehta. It has been finalised that Imran Khan’s plea will be heard on Tuesday, following which a final decision will be made for whether he can continue to stay in India or be forced to head back to his home country, the USA.

Due to Imran Khan being an American citizen and holding an Overseas Citizen of India (OCI) card, his participation in the political protest led to the authorities upholding the Immigration and Foreigners Act. This also urged the legal authorities to deliver to him a show-cause notice with regards to his OCI status, subsequently resulting in him to leave India. While Imran Khan claimed to have no direct hand at participating in the protest and merely being a spectator, the court has still ruled against his favour.

A show-cause notice was delivered to Imran Khan from the Foreign Regional Registration Office (FRRO). In his petition, Imran Khan mentioned how the notice issued by the police was “Illegal, arbitrary, and drastic.” It also stated that “it reflects patent non-application of mind and arbitrary targeting… Not only is the notice manifestly disproportionate, if implemented, it would reduce the very principles of natural justice that the authorities are duty-bound to uphold, to nothing but a dead letter.”

As per Imran Khan, authorities have invoked the provisions under Sections 7 (2)(C) and 29 of the Immigration and Foreigners Act. As per Section 7 (2)(C), the government has the power to regulate or restrict the presence of any foreigner. Section 29, on the other hand, allows the government to directly remove any foreign national for contravening any rules or orders.

Autho9rities have also warned that the deportation proceedings will commence if Imran Khan fails to comply with the deadline set to October 28.
