Hyderabad:The VII Additional Metropolitan Sessions court on Thursday granted bail to Mahbub Alam Khan, second accused in the advocate Khaja Moizuddin murder case of May 23. The court directed Mahbub Alam Khan to execute a personal bond of ₹1 lakh with two local sureties for a like sum. He was also directed to appear before the Nampally police every Wednesday between 11 am and 2 pm until the filing of the chargesheet or until further orders.
The court on Wednesday had rejected the bail plea of the prime accused Mujahid Alam Khan.
Counsel Mohd. Muzaferullah Khan, representing Mahbub Alam Khan, submitted that his client was 80-years-old and had been in remand for 75 days. Citing his age and health condition, counsel requested the court to grant bail, assuring that he would comply with all conditions imposed by the court.
The court directed the accused to not influence or tamper with witnesses, leave the country without prior permission, or change his residential address without informing the court. He was also instructed to surrender his passport, if any, and cooperate with the investigation.
The court ordered that if the accused failed to appear before the magistrate court for judicial proceedings without its permission, and a non-bailable warrant was issued, the bail would stand automatically cancelled and the personal and surety bonds would be forfeited. Any violation of the bail conditions would also lead to cancellation of the bail.
Advocate and Waqf activist Moizuddin died of critical injuries after being rammed by a car near his house at Nampally on May 23. Hyderabad police subsequently arrested seven persons, alleging that they had conspired to kill Moizuddin over a dispute involving Waqf properties.
