Guwahati HC Reserves Order On Pawan Khera’s Anticipatory Bail Application

Guwahati : The Guwahati High Court on Tuesday reserved its order on the anticipatory bail petition filed by Congress leader Pawan Khera in connection with an FIR registered by Assam chief minister Himanta Biswa Sarma’s wife Rinki Bhuyan Sarma in Assam.

A bench of Justice Parthivjyoti Saikia heard arguments from both sides in detail before reserving its ruling.

Senior advocate Abhishek Manu Singhvi, who appeared for Mr Khera, argued that the case is politically motivated and linked to elections. He questioned the fairness of the process, claiming that Mr Khera is not a flight risk and there is no need for arrest.

The Assam Advocate General opposed the bail plea, arguing that the case involves serious offences such as cheating and forgery. He submitted that Mr Khera allegedly used fabricated documents and official seals for political gain and to defame the Assam chief minister and his wife.

He also argued that while immediate arrest was not the primary intention, the police need access to documents and passports for investigation. The prosecution further claimed that Mr Khera poses a flight risk and should not be granted protection.

The legal battle comes amid a series of court developments across different jurisdictions, including earlier interim orders from the Telangana High Court and the Supreme Court relating to transit anticipatory bail.

The FIR against Mr Khera includes multiple charges under provisions of the Bharatiya Nyaya Sanhita, including cheating, forgery, defamation, and other related offences. The Guwahati High Court has reserved its order which is expected to be delivered later.
