New Delhi: Khairatabad MLA Danam Nagender has moved the Supreme Court against the Telangana High Court order disqualifying him from the State Assembly under the anti-defection law. Chief Justice of India (CJI) Surya Kant said the matter will be listed for hearing on Wednesday.
Senior Advocate Mukul Rohatgi mentioned the plea before the Chief Justice of India Surya Kant’s bench. He expressed apprehension that the Election Commission could issue a bypoll notification for the Khairatabad seat in the wake of the High Court verdict.
On Friday, September 18, the Telangana High Court set aside the Speaker’s order rejecting the disqualification petitions filed against Nagender. The court held him disqualified from the Assembly with effect from April 23, 2024.
That is the date on which Nagender contested the Secunderabad Lok Sabha election on a Congress ticket, even though he had been elected to the Telangana Assembly on a BRS ticket. The High Court also declared the Khairatabad Assembly seat vacant.
Because the High Court declared the seat vacant, the Election Commission of India could move to notify a by-election. Nagender’s counsel has urged the Supreme Court to take up the matter before that happens. The Supreme Court’s decision on whether to grant interim relief will determine whether the Khairatabad constituency heads toward a bypoll while the appeal is pending.
