New Delhi: The Special Investigation Team (SIT) on Friday approached the Supreme Court challenging the Andhra Pradesh High Court’s conditions on the custody and conditions imposed to question the former Krishnalanka CI SSVV Nagaraju related to the alleged custodial death of Gade Sai Krishna.
They sought permission to question him in full and to relax the conditions set by the AP High Court.
SIT officials are opposing the condition that mandates full-length video recording during the transit of the accused. They argue that continuous video surveillance of the places connected to the crime scenes and the police Krishna Lanka Police Station could compromise the confidentiality of the investigation.
In its petition filed in the Supreme Court, the SIT stated that the High Court’s conditions are becoming a hurdle to the search for Sai Krishna’s body and to conducting scene reconstruction. The state has urged the apex court to allow the interrogation of the accused without any stringent conditions.
The SIT’s petition is likely to come up for hearing next week.
On Tuesday the AP HC permitted the SIT to take Nagaraju into police custody from July 9 to 16 for crime scene reconstruction and evidence collection. Justice K Maheswara Rao partially modified the conditions imposed by the Magistrate Court, allowing the SIT to take Nagaraju from Rajamahendravaram Central Jail to the places connected with the alleged offences. It ordered that every movement of the accused during his transit from the Jail to Vijayawada and back be videographed. The original video recordings, along with the complete CCTV footage covering the custody period, must be produced before the Vijayawada Magistrate Court on July 17 without any alteration, it stated.
