A surrogate named McKenny West is the person who agrees to carry the pregnancy and deliver the baby to the biological parents. But in California, the arrangement turned bitter when the biological parents asked the surrogate to abort the pregnancy after the fetus was diagnosed with a rare heart condition at birth.

The surrogate mother delivered the baby in Texas against her parents’ wishes at a Dallas hospital. However, the woman is not allowed to meet the child after giving birth. However, she has been receiving support from the Texas Attorney General, Ken Paxton, as she took legal action to compel medical treatment for the newborn.
For those who don’t know, the dispute started after the biological parents found out at 20 weeks of pregnancy that the fetus had a rare and life-threatening congenital heart condition, hypoplastic left heart syndrome. To survive, the child required multiple surgeries, and the intended parents, who live in Los Angeles, wanted to terminate the pregnancy.
However, McKinney’s wife, who lived in Alaska, refused to abort the child; instead, she flew to Texas, which bans abortion by law. She got hold of a specialist who could treat the baby’s defect. Amid legal actions in the three states, McKenny gave birth to a boy and named him ‘Baby Gabriel.
However, the legal parents are devastated to see their family tragedy being transformed into political theatre. The lawyer for the parents, Lee Budner, said:
“As if the heartbreak of his condition were not enough, they are devastated to see their family tragedy transformed into political theatre by the Texas Attorney General’s office and McKenna West.”
Award-winning journalist Caleb Parke shared his opinion on the whole scene. He revealed that the surrogate mother gave birth to Gabriel and refused the demand to abort him, after he was diagnosed with a serious but treatable heart condition. He also revealed that the newborn baby is doing well and is on the path to receiving life-saving medical care.
Soon after his birth, Gabriel was taken to the NICU for treatment of his condition, a serious congenital heart defect, which he was diagnosed with during 20 weeks of pregnancy. The journalist shared:
“The condition leaves the left side of the heart severely underdeveloped. Without treatment, it is typically fatal, but it can be treated through a series of surgeries beginning shortly after birth. McKenna, an Alaskan nurse and single mother of two, entered into a surrogacy agreement with a California couple. According to court filings and reporting on the case, the intended parents sought an abortion after Gabriel’s diagnosis. McKenna refused.
However, the doctors in Alaska couldn’t perform the late-term abortion. So, she was asked to fly somewhere else for the procedure; instead, the surrogate researched her baby’s condition and learned that specialists in Texas had experience treating babies with the same defect.
McKenna even offered to take responsibility for Gabriel herself or arrange for his adoption if the parents did not want to raise him. The journalist further revealed the baby’s health. She wrote:
“Now he is in the NICU, surrounded by medical professionals preparing to give him the chance at life McKenna fought so hard to protect. McKenna may not be Gabriel’s biological mother, but she demonstrated the fierce protective love of a mother by refusing to give up on him when his life was at risk. God bless Baby Gabriel, McKenna West, Ken Paxton and everyone who fought to protect this little boy.”
